Thank you for your interest in BoxCast Inc. (hereinafter, “BoxCast”, “we” or “us”). This Privacy Policy sets forth the terms and conditions with respect to how BoxCast processes personal information about you and other third parties.
This Privacy Policy describes, among other things, the types of personal information that we collect, the purposes for which we use it, the types of third parties with whom we share it, and any rights and responsibilities you may have with respect to such personal information.
This Privacy Policy applies to the personal information you provide us when you visit any website or mobile application that we own, license, or otherwise operate and that links to this Privacy Policy, including but not limited to www.boxcast.com and the Broadcaster mobile application (each, a “Site”), purchase or receive services from BoxCast, apply for a job with BoxCast, or otherwise contact or engage with us. For purposes of this Privacy Policy, the Sites and services furnished by BoxCast shall be referred to collectively as the “Services.”

BY ACCESSING OR USING THE SERVICES OR OTHERWISE PROVIDING US WITH PERSONAL INFORMATION, YOU ARE CONSENTING TO THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT USE THE SERVICES, AND YOU SHOULD LEAVE THE SITE IMMEDIATELY AND NOT PROVIDE US WITH ANY PERSONAL INFORMATION. THE SERVICES ARE INTENDED FOR USERS LOCATED IN THE UNITED STATES AND YOUR INFORMATION WILL BE PROCESSED AND STORED IN THE UNITED STATES. 1. CHILDREN’S PRIVACY:
The Services are not directed at, nor intended for use by, children. As a result, if you are under the age of eighteen (18), you are prohibited from accessing or using the Services (including the Site) or from providing us with your personal information. If we learn we have collected or received personal information from a child under 18, we will delete that information. If you believe we might have any information from a child under 18, please contact us at optout@boxcast.com. If you upload any information about a child under 18, including their image or likeness, you expressly represent that you are or have the express consent of the child’s parent or guardian to upload the information in accordance with this Privacy Policy.
2. TYPE OF INFORMATION COLLECTED:
Information You Provide to Us
When you chat with a BoxCast Representative, create an account, use the Services, view a video stream, or otherwise interact with the Services, you may provide certain personal information to us. This may include name, username, email address, city, state, and or other personal information. If you contact us, we collect records of your correspondence (including email addresses). If you are using the Services on your mobile device, you may provide us with location data. If you use the Services to record a photograph or a video, you may provide us with access to your camera. We may also collect information that you provide when you complete a transaction on our Site. BoxCast uses Stripe, a secure payment provider, to process your payments if you purchase products or services. Your payment information is subject to the privacy policy and terms of use of Stripe. We recommend you review these policies before uploading any credit card information. BoxCast does not have access to your credit card information and does not store this information on our servers.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns. BoxCast collects information of the sort that web browsers and servers typically make available, such as traffic data, log data, crash data, language preference, referring site, and the communication data and resources that you access and use on the Site. BoxCast may also collect information about your device and internet connection, including your Internet Protocol (IP) addresses, operating system, device settings, and browser type. BoxCast’s purpose in collecting such information is to better understand how BoxCast’s visitors use the Services, to personalize and improve our Site, and to help identify spam. We also may use these technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking). Whether we collect some or all of this information often depends on what type of device you’re using and its settings. To learn more about the information your device makes available to us, please review the policies of your device manufacturer or software provider.
The technologies we use for automatic data collection may include “cookies”, web beacons or “flash cookies”. A cookie is a small file placed on your smartphone or other device. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or device. However, if you select this setting, some parts of the Site may become inaccessible or not function properly. In addition, the Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to analyze data on your use of the Site (e.g., recording the popularity of certain content and verifying system and server integrity). Certain features of our Site may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies. Pages of our Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit BoxCast, for example, to count users who have visited those pages and for other related site statistics (for example, recording the popularity of certain content and verifying system and server integrity).
We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources, or that you provide to us.
Information from Other Sources
We may obtain information from third parties and sources other than BoxCast, such as social media or social network platforms for which you have explicitly connected to BoxCast (e.g., information from YouTube using YouTube API Services or any other platform BoxCast connects with). When you connect your social media or social network account to BoxCast, you authorize BoxCast to collect, store and use such information and content in accordance with this Privacy Policy. Please refer to the privacy policy of the social media or social network platforms you use with BoxCast for more information about how such third party sites process your personal information. If we combine or associate information from other sources with personal information that we collect through BoxCast, we will treat the combined information as personal information in accordance with this Privacy Policy. In particular, we may obtain information from the following third party sources:
- YouTube - Google Privacy Policy, If you have connected your YouTube account to your BoxCast account via the YouTube API, you may revoke access to your data via the Google security settings available here.
Our Use of Web Analytics
We use different analytic tools which serve the purpose of measuring, analyzing, and optimizing our marketing measures and provide you with customized advertisements that could be of particular interest to you. In particular, we may use the following tools:
- Google Analytics uses cookies which enable an analysis of your use of the Sites. The information collected (IP address, browsing activities and other data linked to your usage of the Sites) is usually transferred to a Google server in the USA and stored there. You can prevent Google Analytics from recognizing you on return visits to a site by disabling cookies on your browser. - YouTube video widget (Google Inc.) is a video content visualization service provided by Google Inc. that allows the Sites to incorporate video content.
- Vimeo video (Vimeo, LLC) is a video content visualization service provided by Vimeo, LLC that allows the Sites to incorporate certain video content.
3. CHOICES ABOUT DATA DISCLOSURES:
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking in Broadcaster App. You may turn off tracking in the Broadcaster app by accessing your phone settings, clicking on Broadcaster, and using the toggle button to set "Allow tracking" to disabled.
- Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of the Sites may then be inaccessible or not function properly.
- Promotional Offers from BoxCast. If you do not wish to have your information used by BoxCast to promote our own or third parties’ products or services, you can opt-out by choosing to unsubscribe from communication at the bottom of emails from BoxCast or sending an email to optout@boxcast.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. The foregoing unsubscribe option does not apply to communications from BoxCast or third parties in connection with your use of the Services, such as a result of a product purchase, warranty registration, product service experience, subscription purchase, or other transactions.
4. HOW WE USE YOU INFORMATION; PURPOSE OF COLLECTION:
We use the information we collect to provide you full access and functionality of the Services. Accordingly, your information may be used for the following purposes to: (i) provide, improve, operate, maintain and promote our Services; (ii) enable you to access and use our Services; (iii) enable users to enjoy and easily navigate the Sites; (iv) better understand your needs and interests; (v) fulfill requests or to respond to questions or comments you may make; (vi) furnish technical notices, updates, security alerts, and support and administrative messages to you; (vii) personalize our Services, including providing features, announcements, notifications, and advertisements related to your interests and preferences; (viii) provide service announcements or transactional messages; (ix) investigate and prevent fraudulent transactions, unauthorized access to or use of our Services and other illegal activities; (x) assess the level of general interest in the Services, (xi) process and deliver contest or sweepstakes entries and rewards and (xii) for any other purpose with your consent.
5. SHARING INFORMATION; THIRD-PARTY DISCLOSURES:
We may share your personal information with certain organizations and third parties in accordance with applicable law, including as set out below. However, we do not share personal information with third parties that we have reason to believe use such information for their own direct marketing purposes. Some organizations and third parties may be located outside of your home country and by using the Sites, you consent to the transfer of such information to them. In the event that you facilitate a transaction with BoxCast, or request information from or otherwise engage with us, and such activities require BoxCast to share your personal information with a service provider or other third party, you hereby consent to such disclosure and/or direct BoxCast to intentionally disclose your personal information to the service provider or third party.
Service Providers. We may share your personal information with companies that provide services on our behalf, such as hosting and analyzing the Sites, conducting surveys and marketing on our behalf, processing transactions (including rebates and returns), tracking and responding to consumer questions or complaints, and performing analyses to improve the quality of our Services.
Business Partners. We may share your personal information with third parties that distribute our products and marketing materials.
Business Restructuring. Circumstances may arise where, for strategic or other business reasons, BoxCast decides to sell, buy, divest, merge or otherwise reorganize our businesses. We may disclose your personal information to the extent reasonably necessary to proceed with the negotiation or with the completion of a merger, acquisition, divestiture or sale of all or a portion of BoxCast’s assets.
Legal Requirements and Legitimate Interests. We may disclose personal information when we believe such disclosure is appropriate or necessary to: (i) comply with applicable law and legal processes; (ii) respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iii) enforce a contract with us; (iv) protect our rights, privacy, health, safety, or property, and/or that of our affiliates, you or others; and (v) allow us to pursue available remedies or limit the damages that we may sustain.
Other Disclosures. We may disclose your personally-identifying information if you expressly consent to the disclosure. We may disclose non-personally identifiable aggregated information about our users without restriction.
Custom App Specific Disclosures: If you use Custom Apps administered by a particular church and you submit a prayer request or other information to be viewed by the church, such information will be shared with and visible to the church that is administering the Services to be used by the church without restriction. Please only submit prayer requests or other information that you are comfortable disclosing to an administering church in accordance with this section.
6. SOCIAL MEDIA:
We may engage with you on various social media platforms. If you contact us on a social media platform for customer support or for other reasons, we may contact you via the social media’s direct message tools. Those communications to and from us are governed by this Privacy Policy. However, your use of a social media platform is also subject to the policies and terms of the relevant social media platform. Certain social media platforms may also automatically provide us with your personal information, and the information we receive will depend on the terms that govern your use of the social media platform(s) and any privacy settings you may have set. The Site may include social media features and widgets or interactive mini-programs that run on the Site. These features may collect your IP address and which Site page you are accessing and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Site. Your interactions with these features are governed by the privacy policies of the relevant social media platform that provides them.
7. LINKS TO OTHER WEBSITES; YOUR DIRECT THIRD-PARTY DISCLOSURES:
As a resource to you, the Site may include links to third-party websites or provide you the opportunity to disclose information directly to third parties (e.g., credit card processors). Our Privacy Policy does not apply to such third-party websites or organizations. You assume all privacy, security, and other risks associated with providing any data, including personal information, to third parties via the Services. For a description of the privacy protections associated with providing information to third parties, you should refer to the privacy policies, if any, provided by those third parties.
8. PUBLICLY POSTED INFORMATION:
The Sites may provide you with the ability to submit a comment on, provide an opinion about, rate, or otherwise discuss our Services or provide other information (“Feedback”), and such Feedback may be posted to a publicly available portion of the Sites. Any information or content you post in your Feedback may be available to other users of the Site (and our social media platforms, if any) and may be retrievable by third-party search engines, and third parties may also be able to download or share your Feedback to social media websites or elsewhere. We recommend that you guard your privacy and anonymity and not upload any information in your Feedback that you wish to remain confidential. Any third party with access to your information via the Sites will be permitted to use the information in the same manner as if you submitted the information directly to that third party. Publicly posting any information on the Sites is entirely voluntary on your part, and we recommend you carefully consider the information you choose to make publicly available.
9. YOUR RIGHTS AND RESPONSIBILITIES:
Responsibilities. You are permitted, and hereby agree, to only provide personal information to BoxCast if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation. IF YOU PROVIDE PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO BOXCAST, YOU EXPRESSLY REPRESENT AND WARRANT TO BOXCAST THAT YOU HAVE THE FULL RIGHT AND AUTHORITY TO PROVIDE BOXCAST WITH SUCH PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) AND THAT BOXCAST’S USE AND PROCESSING OF SUCH PERSONAL INFORMATION AS SET FORTH HEREIN WILL NOT VIOLATE ANY PERSON’S RIGHTS OR PRIVILEGES, INCLUDING RIGHTS TO PRIVACY. YOU HEREBY AGREE TO FULLY AND COMPLETELY INDEMNIFY BOXCAST FOR ANY CLAIMS, HARM, OR DAMAGES THAT MAY ARISE FROM YOUR PROVISION OF PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO BOXCAST.
Data Protection Rights. You may have certain rights under applicable data protection laws with respect to personal information about you that is collected through the Sites or when you contact or otherwise engage with us. Residents of certain states may have additional data privacy rights, including the following:
- Right to Know: The right to know about what personal information BoxCast collects about you, and our intended use of, and purposes for collecting, your personal information. The personal information that we collect from you, the purposes for which it is used, the source of such personal information, and the parties to whom we share your personal information, among other issues, are set forth in this Privacy Policy.
- Access: The right to access general categories and/or the specific pieces of personal information we have collected, used, disclosed, or sold about you over the past twelve (12) months, including the sources from which the personal information was collected; the business or commercial purpose for which your personal information was collected, used, disclosed, or sold; and, the third parties with whom we have shared your personal information.
- Deletion/Erasure: The right to request that we delete/erase your personal information under certain circumstances.
- Data Portability: The right to request that we transfer, to the extent technically feasible, personal information in certain forms and formats.
- Nondiscrimination: The right not to be subject to discrimination for asserting your rights.
To exercise any of these data privacy rights, please contact us, or have your authorized agent contact us, in accordance with the “Contact Us” section listed below. In the event you submit, or your authorized agent submits on your behalf, a data request, you (and your authorized agent) hereby acknowledge and agree, under penalty of perjury, that you are (or the authorized agent of) the consumer whose personal information is the subject of the request. We will respond to any data requests within the timeframes required by law, and we may charge a fee to facilitate your request where permitted by law. If you make, or an authorized agent on your behalf makes, any request related to your personal information, BoxCast will ascertain your identity to the degree of certainty required under applicable law before addressing your request. BoxCast may require you to match at least three pieces of personal information we have previously collected from you before granting you access or otherwise responding to your request. We may require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein, unless you have provided the authorized agent with power of attorney in compliance with applicable law. None of these rights are absolute and are subject to legal and regulatory exceptions and exemptions.
Nevada Privacy Disclaimer. Pursuant to Nevada law, a Nevada “consumer” (as the term is defined therein), may, at any time, submit a verified request through a designated request address to an “operator” directing the operator not to make any sale of his or her personal information that the operator has collected or will collect about the consumer. For clarity purposes, BoxCast does not sell or exchange your personal information for monetary consideration to a third party for the third party to license or sell the information to additional persons or parties.
Marketing. You have the right to opt-out of receiving electronic direct marketing communications from us. All electronic direct marketing communications that you may receive from us, such as e-mail messages, will give you an option of not receiving such communications from us in the future. You may utilize third-party tools available from the Digital Advertising Alliance and the Network Advertising Initiative. Because these opt-out tools are device and browser-specific, you must repeat the opt-out process from each of your browsers and devices.
Do Not Track. Some web browsers may transmit “do-not-track” signals to the sites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.
We Do Not Sell Your Personal Information. BoxCast does not, to the best of our knowledge, sell or rent personal information that we have collected or retain about you to any other third-party. We only disclose your personal information to third parties in accordance with this Privacy Policy. Accordingly, we do not offer individuals the ability to “opt-out” of the selling or renting of personal information because we do not engage in those practices.
Persons with Disabilities. BoxCast strives to ensure that every person has access to information related to our Services, including this Privacy Policy. Please contact us in accordance with the “Contact Us” section listed below if you would like this Privacy Policy provided in an alternate format, and we will seek to meet your needs.
10. EMPLOYMENT APPLICATIONS AND TALENT MANAGEMENT:
As part of our recruitment and talent management process, we collect personal information with respect to individuals who are interested in working for us. In this context, we collect employment and application data, such as the following: contact information (e.g., name, title, residential or postal address, telephone number, and personal email address); information in a curriculum vitae, resume, cover letter, or similar documentation; details regarding the type of employment sought, willingness to relocate, job compensation and benefit preferences; health data (e.g., medical conditions); information related to your background, education, criminal record, credit history and similar data; information provided about or by your references or other third parties related to your employment history, skills, qualifications, or education; and information related to previous applications to us or previous employment history with us. When permitted by law, we may collect information about your race and ethnicity to assist with our diversity and inclusion programs. We use this information for the following purposes: to identify and evaluate job applicants; to verify your information; to complete employment, education, background and reference checks; to communicate with you about the recruitment process and your application; to comply with our legal, judicial, regulatory, administrative, or other corporate requirements; to analyze and improve our application and recruitment process; to accommodate individuals who may have specialized needs during the employment process; and to protect the rights, interests, and property of our business, other job applicants, employees, or the public, as required, or permitted, by law. We may share this personal information with third parties (see “Sharing Information / Third-Party Disclosures”), and we may also use this employment and application data for any other purpose set forth in this Privacy Policy.
11. ACCESSING, DELETING, AND CORRECTING YOUR INFORMATION:

We may not be able to delete your personal information without also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement, cause the information to be incorrect, or to protect our rights or the Services.
12. DATA RETENTION; LOCALIZATION:
The period during which we store your personal information varies depending on the purpose for the processing. For example, we store personal information needed to provide you with products and services, or to facilitate transactions you have requested, for so long as you are a customer of BoxCast. We store your personal information for marketing purposes until you have opted-out of receiving further direct marketing communications in accordance with applicable law. In all other cases, we store your personal information for as long as is needed to fulfill the purposes outlined in this Privacy Policy, following which time it is either anonymized (where permitted by applicable law), deleted or destroyed.
BoxCast is based in the United States and the personal information that we collect and process is retained and stored in the United States. BoxCast uses service providers that store personal information on our behalf in the United States and in other countries. Your personal information may be accessible by, or otherwise made available to, local government authorities and officials pursuant to judicial and/or administrative orders, decrees, and demands, and/or other domestic laws, statutes, and regulations. By continuing to provide us such information, you hereby consent to your personal information being transferred to, and stored in, the United States and in such other countries.
13. SECURITY:
We seek to protect the security of your personal information and use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. HOWEVER, NO INFORMATION SYSTEM CAN BE FULLY SECURE AND WE CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR PERSONAL INFORMATION. MOREOVER, WE ARE NOT RESPONSIBLE FOR THE SECURITY OF PERSONAL INFORMATION YOU TRANSMIT TO THE SITE AND/OR THE SERVICES OVER NETWORKS THAT WE DO NOT CONTROL, INCLUDING THE INTERNET AND WIRELESS NETWORKS, AND YOU PROVIDE US WITH ANY PERSONAL INFORMATION AND DATA AT YOUR OWN RISK. TO THE EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE OR OTHERWISE RESPONSIBLE FOR ANY DATA INCIDENT OR EVENT THAT MAY COMPROMISE THE CONFIDENTIALITY, INTEGRITY, OR SECURITY OF YOUR PERSONAL INFORMATION CAUSED BY A THIRD PARTY. The safety and security of your personal information also depends on you. Where we have given you (or where you have chosen) a username and password to access our Services, you are responsible for maintaining the security and confidentiality of those credentials and not revealing them to others. You must contact us immediately if you have reason to believe that your username or password to our Services has been compromised. You acknowledge and agree that we may contact you via email or other electronic communications in the event we are legally required to notify you of a data security incident or event related to your personal information.
14. MODIFICATIONS OF THIS POLICY:
We reserve the right to amend this Privacy Policy at any time. We will notify you if this Privacy Policy is amended by updating the “Last Updated” section listed above. It is your responsibility to periodically review the Privacy Policy to determine whether any amendments have been made hereto. Your use of the Services, and continued use of the Services after any amendments are made to this Privacy Policy, signifies your consent to this Privacy Policy and any amendments hereto. We may, in our sole discretion, provide you communications, including via email or text messages, about changes to our Privacy Policy; however, such communications do not abrogate or otherwise limit your responsibility to periodically review the Privacy Policy to determine whether any amendments have been made hereto.
